Thiessen: Special counsel should have let 'written work speak for itself'

Special counsel Robert Mueller's spokesman strongly denies claims in a Michael Wolff new book that Mueller prepared a draft indictment of President Trump on obstruction of justice.

First, Mueller argued and leaned on a view from the Justice Department's Office of Legal Counsel that a sitting president can not be indicted.

Trump's tweet came after Mueller made his first public statement since releasing his final report nearly two months ago.

"Charging the president with a crime was therefore not an option we could consider", Mueller said.

In his own public comments, Attorney General William Barr has leaned heavily on the idea that Mueller did not feel the guidelines are what prevented him from charging President Donald Trump with obstruction.

The documents reviewed by the Guardian listed a first count, under Title 18, United States Code, Section 1505, charging the president with "corruptly - or by threats of force or threatening communication - influencing, obstructing or impeding a pending proceeding before a department or agency of the United States".

In particular, his office found that Moscow attempted to boost Trump's prospects at the expense of his Democratic presidential rival, Hillary Clinton (see: 10 Takeaways: Russian Election Interference Indictment). This threatens to undermine a central objective for which the Department appointed the Special Counsel: "to assure full public confidence in the outcome of the investigations".

"We did not, however, make a determination as to whether the president did commit a crime".

So are we any clearer as to whether Robert Mueller and his team believe the President did commit the crime of obstruction of justice, in trying to have the Mueller inquiry shut down and Robert Mueller himself sacked?

Regarding Mueller's rationale to defer prosecuting the president, Wolff writes, the former Federal Bureau of Investigation director and U.S. Attorney did not reach the top echelons of government "by misconstruing the limits of bureaucratic power".

Moments after his statement, Democrats in Congress were calling for action. Instead, he wrote a summary to Congress that Democrats said inaccurately portrayed Mueller's conclusions as more favorable towards Trump than they actually were.

The president said he would work to expose the origins of the investigation, describing the law enforcement officials involved as corrupt.

Chairman Jerry Nadler (D-NY) has pushed the department to schedule testimony from Mueller, but no date has been set. Since he didn't find this exculpatory evidence, Mueller deemed Trump "not exonerated". "We chose those words carefully and the report speaks for itself", he said.
