Reported federal plan on gender definition draws outrage

Trump administration reportedly considering denying recognition of transgender people only defining gender as sex assigned at birth

"Setting a destructive precedent, the Trump-Pence administration intends to erase LGBTQ people from federal civil rights protections and eviscerate enforcement of non-discrimination laws", said HRC President Chad Griffin.

The Department of Health and Human Services could establish a legal definition of gender under Title IX, which would be based on a person's genitalia at birth, a memo obtained by the news outlet showed. Under the reported proposal, the federal government would rely on the sex listed on a person's birth certificate as originally issued, regardless of whether the person has undergone gender reassignment surgery or had their birth certificate amended.

This policy would not prevent any person from identifying as any gender they please; despite the outrage-filled headline put forth by the New York Times, this policy would not write transgenderism out of existence.

Such an interpretation would reverse the expansion of transgender rights that took place under the previous administration of President Barack Obama.
