ICC 'undeterred' after US sanctions threat

John Bolton, the hawkish USA national security adviser, has threatened the International Criminal Court (ICC) with sanctions and made an excoriating attack on the institution in a speech in Washington.

Last November, the ICC prosecutor requested authorization to investigate war crimes and detainee abuse allegations against US servicemembers and intelligence professionals in Afghanistan.

National Security Adviser John Bolton was expected to discuss the plans in a speech Monday, saying the Trump administration wouldn't keep the office open 'when the Palestinians refuse to take steps to start direct and meaningful negotiations with Israel, ' according to prepared remarks.

Bolton said on Monday that the United States will impose sanctions on court officials who attempt to investigate either the USA or Israel.

The court announced in November 2016 that a preliminary examination of the war in Afghanistan had found a "reasonable basis" to believe that American forces had committed war crimes of torture and related ill-treatment. "We will negotiate even more binding bilateral agreements to prohibit nations from surrendering USA persons to the ICC", said Bolton.

Bolton then issued a very clear threat: If the global court continues to pursue the probe, Washington will ban ICC judges from entering the country, prosecute them and sanction their funding.

In a speech Monday, John Bolton said Washington would not cooperate with The Hague-based court and threatened it with sanctions, saying it put US sovereignty and national security at risk.

Trump's national security adviser also threatened other nations that may work with the ICC. And we certainly will not join the ICC.

Since Trump took office on January 20, 2017, Israel - a traditional US ally that receives $3.1bn in annual military aid from Washington (next year, that figure will increase to $3.8bn under a 10-year deal agreed by former US President Barack Obama) - has taken a series of measures that have been criticised as "racist" and "discriminatory" against the Palestinian people.

Bolton went on to accuse the PLO leadership of '(condemning) a USA peace plan they have not yet see and refused to engage with the U.S. government with respect to peace efforts and otherwise'.

Responding to Washington's move to close down the PLO's offices in the U.S. capital, Saeb Erekat, the organisation's secretary-general, said in a statement that it was "another affirmation of the Trump administration's policy to collectively punish the Palestinian people".

The United States has not signed up to the court and in 2002 Congress passed a law technically enabling Washington to invade the Netherlands to liberate any U.S. citizen, should they be held by the court.

The second area Mr Bolton addressed was the Palestinian move to bring United States ally Israel before the ICC over allegations of human rights abuses in Gaza and the occupied West Bank - a move dismissed by Israel as politicised.

Bolton's speech comes as the Trump administration is shuttering the Palestine Liberation Organization office in Washington, a controversial move that Bolton confirmed in his speech.

"This is an additional measure that must make it very clear to the current and future Palestinian leaders that the USA is not an actor to be ever trusted when it comes to any matter related to "peace" negotiation and talks".

Earlier this month, the USA halted funding of the United Nations agency that supports Palestinian refugees.

The Palestinians say USA officials have notified them their mission will be closed, the latest in a series of American blows to the Palestinians.

"In theory, the ICC holds perpetrators of the most egregious atrocities accountable for their crimes, provides justice to the victims, and deters future abuses", Bolton said. "We will let the ICC die on its own", Bolton said.

The Trump administration lashed out Monday at two of its favorite diplomatic punching bags, the International Criminal Court and the Palestinians.
