Canadian court blocks controversial oil pipeline project | TheHill

Bill Morneau, Canada's finance minister, said the government is reviewing the court's decision carefully, but it has not yet decided what its exact response will be.

He said an "essential" element of the plan to reduce carbon emissions was Alberta's commitment to cap emissions from the oilsands.

In a ruling issued on Thursday morning, the Federal Court of Appeal said the National Energy Board of Canada (NEB) made a "critical error" in issuing a report the federal government relied on to give the project the green light in 2016.

But the court has determined that conclusion is bogus because it did not assess the impacts of marine shipping - increased tanker traffic that would result from the expanded pipeline - on the environment and southern resident killer whales in the waters around the line's shipping terminal.

The Union of B.C. Indian Chiefs applauded the ruling, and demanded the pipeline be shutdown immediately.

Chief Bob Chamberlin, Vice-President of the UBCIC called the ruling "a major win with impacts that will be felt across the country". "I was initially surprised", he said. "While we want to make sure that the project proceeds, we also want to make sure it moves ahead in the right way".
