Putting the $17 Million Price Tag of the Mueller Investigation in Context

President Donald Trump's lawyers, in a newly reported confidential letter hand-delivered to Russian Federation probe special counsel Robert Mueller, tried to keep Trump from testifying by arguing that it is not possible for him to have committed obstruction of justice and that he could he could be unfairly exposed to accusations if he answers questions. It's a move that some critics might view as the legal case for ending the Mueller investigation. Brian Schatz likened Trump to former President Richard Nixon during the Watergate scandal in attacking the letter.

A memo dated January 29, 2018, argues that the Constitution gives the president vast authority to, for instance, fire FBI Director James Comey, and even argues that the president can not obstruct justice by terminating an investigation.

Giuliani has said that the president's legal team believes the special counsel does not have the authority to do so.

Mr Giuliani said a decision about an interview would not be made until after Mr Trump's summit with North Korean leader Kim Jong Un on June 12 in Singapore, and he cast doubt that it would occur at all.

The arguments parallel those that the president's attorneys have pressed publicly for months, even as quiet negotiations over whether Trump might agree to sit voluntarily for an interview have continued.

Before the Times published its story on the letter, Trump accused Mueller and the DOJ of "leaking my lawyers letters to the Fake News Media" and suggested authorities should be investigating Democrats instead.

"If Mueller tries to subpoena us, we're going to court", Giuliani told ABC News.

It also asserts that, under the power of the Constitution, Trump could "if he wished, terminate the inquiry".

In an opinion piece written for the Wall Street Journal on May 13, Steven Calabresi, who once served as a special assistant to Attorney General Edwin Meese and as a law clerk to Justice Antonin Scalia, argued that the broad powers bestowed upon Mueller qualify him as a "principal officer" who by law must be appointed by the president and confirmed by the Senate. He added: "When will this very expensive Witch Hunt Hoax ever end?"

David Sklansky, who teaches criminal law at Stanford, told us it is simply not accurate for the president to claim that the appointment of Mueller was unconstitutional.
