When the Federal Communications Commission overturned net neutrality rules that ensured ISPs had to treat all websites and web services equally, it also decided that its own wishes should over-ride those of individual states.

In December, the commission's Republican majority voted to rollback net neutrality rules that had prohibited broadband service providers from blocking or throttling content or creating "fast lanes" to provider better service to companies that pay for it.

"Washington will be the first state in the nation to preserve the open internet", Washington Gov. Jay Inslee said during a bill signing ceremony.

While the FCC's plan to dissolve it is still set for April 23, pending lawsuits could put that in jeopardy, along with several politicians trying to keep it in place.

The state's law prohibits broadband companies from blocking legal content, applications and services, or blocking "non-harmful devices" from connecting to their networks. Under a nonprofit called the Coalition for Internet Openness, the companies said they filed a petition with the Court of Appeals for the DC Circuit today requesting the court review the FCC's decision. However, the FCC's order bars state laws from contradicting the federal government's approach, setting up the possibility that state efforts like Washington's will wind up in court.

Other states are following a similar process, including California, New York and MA, and others could follow as well. And multiple governors, including in NY and Montana, have signed executive actions that prohibit internet service providers with state contracts from blocking or slowing data on their lines.
