Russia's Kaspersky Lab sues USA government for software ban

Moscow Tech Firm Fights Ban by Homeland Security

Russian anti-virus maker Kaspersky Lab is suing the USA government for its decision to ban the company's software in federal agencies and departments, according to an open letter written by company founder Eugene Kaspersky.

In a statement, the company complained that the move by DHS was unconstitutional and denied it due process.

"Kaspersky Lab hopes to protect its rights under the U.S. Constitution and U.S. federal law, receive adequate due process, and fix the reputational and commercial damage caused by Binding Operational Directive 17-01", Kaspersky wrote.

Among other issues, the presidents discussed such urgent problems as the North Korean nuclear settlement. North Korea also started as a Soviet satellite state, so its ties with Russian Federation run deep.

In response, Kaspersky Lab is saying it did not receive due process, and that DHS has harmed the company's reputation and commercial interests "without any evidence".

In September, the Department of Homeland Security (DHS) told U.S. government agencies to remove Kaspersky Lab from their computer networks within 90 days. Last week President Donald Trump signed into law legislation which banned the use of Kaspersky's antivirus and other applications in the US Government.

"There was no subsequent communication from DHS to Kaspersky Lab until the notification regarding the issuance of Binding Operational Directive 17-01 on September 13, 2017", Kaspersky said. In July, Kaspersky Lab reached out to DHS to address the concerns, and stressed that it had no ties to any government or cyberespionage campaigns.

DHS didn't immediately respond to a request for comment.

He said the UK's National Cyber Security Centre was to write to all government departments warning against using the products for systems related to national security. USA officials have said that step, while welcome, would not be sufficient.

Following the ban, Kaspersky said that his company did not intend to close its business in the United States, adding that the company's sales strategy would remain practically unchanged as it focused on small and medium businesses and online sales of individual products. But the company was never given a fair hearing, according to the company's CEO. But the spying concerns continue to dog the company.
