In a further rollback of Obama-era regulations, the Republican-led Senate voted narrowly to repeal a banking rule that would have allowed consumers to join together to sue their bank or credit card company to resolve financial disputes. However, it is inexcusable when plaintiffs' lawyers and consumer advocates blatantly distort the impact that the override of the arbitration rule will have on members of the military.

The Treasury said that the rule will "impose extraordinary costs", generating an additional 3,000 class-action lawsuits over the next 5 years.

"Without the CFPB rule, consumers can be forced into a rigged system where they have no recourse". Many of them issued statements citing studies asserting that the rule would do more harm than good for consumers.

Some finance experts say it reflects the enormous clout of banks and Wall Street firms in Washington, and a penchant among political conservatives to see lighter regulation as an economy-friendly move, even in the wake of the 2008 crisis, which was rooted partly in financial-industry excesses and improprieties.

A Treasury report argued that plaintiffs in class action lawsuits were no better off than they were under forced arbitration.

One approach recommended by the Treasury was to collect data by "comparing historic consumer complaint (or consumer action rates) among providers with and without pre-dispute arbitration clauses in their contracts with consumers". Consumers noticed that when they signed up for Equifax's monitoring services after the breach, the company originally had a forced arbitration clause in its contract. In those same jurisdictions, the issuers filed more than 41,000 small claims against consumers, most of which were probably debt-collection cases. "But a bank can make a lot of money off of $30 [mistakes] ... when you multiply it by millions".

Most people who geta share of class-action settlements get a pittance as their reward, Treasury added: on average, $32.35 per person. Of the cash that was paid out, just under one quarter went to attorneys. As the CFPB said when it created the rule, it was designed to preventing companies from "sidestep [ing] the court system" by "forcing consumers to give up or go it alone". Republicans latched on to the rule as a way to cast the agency as a player in the regulatory regime that was impeding business and the economy.

The example of Wells Fargo, the large national bank caught defrauding customers by signing up them for fee-based accounts and auto insurance they never wanted, brought the issue into the limelight. "This repeal will hurt millions of consumers".

On the flip side, allowing the rule to stand likely would have caused an explosion of class-action lawsuits.

Those estimates seriously understate the true costs, the US Treasury charged in a report released this week.

The data set was too small to guarantee that there was no extra cost, according to Alexei Alexandrov, a former senior economist at the CFPB who wrote the analysis.

While hard to project exactly, and relying on some assumptions, "it should be in the same order of magnitude [as the current cost of class-action litigation] - at most a dollar per consumer per year (and likely much less, if any)", he says.

The math of Cordray's response letter actually equaled Mnuchin's sum in part: Cordray said a 2015 study requested by Congress showed "at least 34 million consumers received cash payments from class actions over five years, and that $1.1 billion was actually paid out to consumers".
