EPA Readying Tuesday Rollout to Repeal Clean Power Plan, Pruitt Says

Environmental Protection Agency Administrator Scott Pruitt said Monday in Kentucky that he plans to sign a proposed rule tomorrow repealing the plan, which aimed to restrict greenhouse gas emissions from coal-fired power plants, according to the Associated Press.

"The EPA proposes to take this action because it proposes to determine that the rule exceeds its authority under the statute, that those portions of the rule which arguably do not exceed its authority are not severable and separately implementable, and that it is not appropriate for a rule that exceeds statutory authority - especially a rule of this magnitude and with this level of impact on areas of traditional state regulatory authority - to remain in existence pending a potential, successive rulemaking process", it says.

The Clean Power Plan requires states to meet carbon emission reduction targets based on their energy consumption.

"We can't comment on the authenticity of the document, but what we can say is that the Obama Administration pushed the bounds of their authority so far that the Supreme Court issued a stay - the first in history - to prevent the so-called "Clean Power Plan" from taking effect", said EPA spokeswoman Liz Bowman.

"As much as we want to see progress made with clean air and clean water, with an understanding that we can also grow jobs, we have to do so within the framework of what Congress has passed", Pruitt said. The administration will ask whether the EPA can or should develop a replacement rule - and, if so, what actions can be mandated at individual power plants.

The Natural Resources Defense Council vowed to wage a legal fight to protect the rule, which President Barack Obama passed in 2015 with the goal of significantly reducing carbon emissions by 2030. But that was expected to coincide with bigger, broader changes - such as using more cleaner-burning natural gas, adding more renewable power projects and simply encouraging customers to do a better job turning down their thermostats and turning off their lights. Obama's EPA administrator, Gina McCarthy, called the proposal "just plain backwards".

In March this year, President Donald Trump signed an executive order, directing the EPA to "suspend, revise, or rescind" the Obama-era rule. A 2015 analysis found the combined health and climate benefits of the plan totalled $33 billion a year. And they are still pushing the Trump administration to be creative now.

Liz Perera, climate policy director for the Sierra Club, said repealing the Clean Power Plan "is about one thing and one thing only: helping corporate polluters profit".
