Kenya's Supreme Court Overturns Election Result

Supporters of Kenyan opposition leader Raila Odinga have exploded in celebration after the Supreme Court nullified last month's presidential election and called for a new vote within 60 days.

"It is therefore inappropriate and foolhardy for IEBC to embark on the planning of a fresh elections without full compliance with the Supreme Court orders and in the redeployment of technology in the fresh presidential election", he said.

Kenya's top court on September 1 upheld the main opposition's complaint that Kenyatta's victory in the August 8 vote was aided by rigging in a shock decision that marked the first time a court in Africa has overturned the results of a presidential election.

The court ruled that the presidential elections were not conducted in accordance with the constitution rendering the result invalid, null and void.

In a ruling that reverberated across the African continent, Kenya's top judges ruled Thursday that the results of the August 8 election, which Kenyatta won with 54 percent, a margin of 1.4 million votes, were invalid due to evidence of voting irregularities and improper return tabulations.

Dissenting judges said that the NASA (National Super Alliance) opposition alliance - which had petitioned the Supreme Court - failed to prove claims that the polls had been rigged.

The credit rating agency said that a ruling to invalidate August's presidential election result was a credit negative for the East African country.

"I personally disagree with the ruling that has been made today, but I respect it", Uhuru said in a state address.

"The president of this country referred to the president of the Supreme Court and the other judges as "wakora", or crooks in Swahili, it said".

"We will not share power", Odinga said, speaking in Kiswahili outside a church in Nairobi.

Kenyans had been braced for another round of protests if the court upholds Kenyatta's victory.

In a historic ruling on Friday, for the first time on the continent a court ruled against the electoral victory of an incumbent. Large numbers of police forces have been deployed.
